Investigation paper on Ratu Naga involving clip of PM's wife submitted to AG, says police

KUALA LUMPUR: Police have submitted the investigation paper (IP) involving a social media post that was deemed to have defamed the Prime Minister's wife Datuk Seri Dr Wan Azizah Wan Ismail with the Attorney-General's Chambers (AGC).

Bukit Aman Criminal Investigation Department (CID) director, Datuk Seri Mohd Shuhaily Mohd Zain said the IP, which was submitted according Article145(3) of the Federal Constitution, is currently under review.

This, he said, following the failure of content creator Syarul Ema Rena Abu Samah, also known as "Ratu Naga" to cooperate with police investigation into the case, which is an offence under Section 249 of the Communications and Multimedia Act 1998.

"The police have clarified that the reluctance to cooperate in the investigation is to be viewed in the context of the failure to provide information regarding access to computer data.

"This is as outlined in Section 116B of the Criminal Procedure Code and Section 249 of the Communications and Multimedia Act 1998.

"According to these provisions, a police officer is entitled to be provided with access to computer data, which includes access codes, encryption codes, decryption codes, software, hardware, and any other necessary means to facilitate the investigation," he said in a statement.

He also stressed that there has been neither misuse of power nor misconduct throughout the investigation into the case.

"The entire process has been conducted professionally and complies with the legal procedures established by the law," he said.

In October, police reports were lodged against three social media users for allegedly uploading posts that contained defamatory content against Dr Wan Azizah.

The report was filed by Bandar Tun Razak PKR branch women's chief, Jamilah Syed Mohamed, at the Cheras district police headquarters.

The report claimed that Ratu Naga had shared a post from the Instagram account @b.netanyahu, which uploaded images featuring the wives of leaders attending the United Nations General Assembly (UNGA), including one that appeared to look like Dr Wan Azizah, seen having evening tea with the wives of United States President Joe Biden and Israeli Prime Minister Benjamin Netanyahu.
