Woman gets community service for reckless driving, causing man's death

KOTA KINABALU: A woman was ordered to serve eight months of Compulsory Attendance Order (CAO) by the magistrate's court here, for reckless driving resulting in the death of a motorist five years ago.

Magistrate Stephanie Sherron Abbie ordered Oi Yi Li, 26, to fulfil four hours of CAO daily in default of three-month imprisonment.

The court made the decision yesterday, after a full trial. Five witnesses were called at the prosecution's stage, while the accused was the sole witness during his defence.

Oi was found guilty of driving recklessly which caused the death of a male motorist aged 55 at 5am on August 26, 2018, at the Jalan Tunku Abdul Rahman traffic lights, near here.

She was convicted under Section 41 (1) of the Road Transport Act 1987, which provides for a jail term of up to 10 years and a fine upon conviction.

Counsel Kimberly Ye and Chen Wen Jye represented the accused. Traffic Prosecuting Officer Khairul Nizam for the prosecution.

Earlier during mitigation, Ye asked for leniency, saying that the accused was only 21 years old at the time of the incident and that she was a first-time offender.

Ye said the sentence should be reformative and rehabilitative. She further informed the court that the accused is still studying at a university and performing well.

In reply, the prosecution among others urged for an appropriate sentence saying among others that evidence such as CCTV footage clearly proves that the accused was negligent to the point of causing an accident that caused the death of the deceased.
