Minor charged with stabbing elder brother to death 

KULIM: A 17-year-old was charged at the magistrate's court here today with the murder of his elder brother at their home  here last week.

The accused, whose identity is being withheld for being a minor, nodded when the charge was read in Tamil by the court interpreter before Magistrate B. Sri Pracha Nanthini.

The accused is charged with murdering his 23-year old brother by stabbing the latter right at his heart.

He is alleged to have committed the offense about 10.10am at their home in Taman Mahkota on August 7.

The charge was framed under Section 302 of the Penal Code which carries death penalty upon conviction. No plea was recorded from the accused. 

Police's prosecution officer Inspector Muhammad Shafiq Shafie prosecuted while the accused was represented by K. Kiren Ram from the National Legal Aid Foundation. 

The court fixed September 26 for mention pending a post-morterm report and no bail was offered to the accused as it is a non-bailable offense. 

Meanwhile, another elder brother was fined RM1,500 by the same court after he pleaded guilty to a charge of lodging a false police report over the victim's death.

Sri Pracha meted out the sentence after the accused admitted to lodging a false police report that the deceased had died after falling in a goat pen.

He had lodged the false report at the Kulim police station, with the intention to cover up for his underaged brother.

The charge was framed under Section 182 of the Penal Code which carries up to six months jail or maximum RM2,000 fine, or both upon conviction.

Kiren Ram pleaded for leniency as the accused earns RM1,500 monthly and has seven family members to support. 

It is understood that the 26-year old brother later paid the fine.
